These Terms govern use of OCR411.com, including informational content, race information, user submissions, third-party links and other website features. They should be read together with OCR411's Privacy Policy and Medical & Safety Disclaimer.

These Terms of Use (“Terms”) govern your access to and use of OCR411.com (“OCR411,” the “Site,” “we,” “us,” or “our”). Please read them together with the other policies and disclosures referenced below.

By accessing or using OCR411, you acknowledge these Terms. Where affirmative agreement is required by applicable law or by a particular site feature, OCR411 may require an additional action such as checking a box or submitting a form containing a notice referring to these Terms.

If you do not agree to these Terms, do not use features that require your agreement and discontinue use of the Site.

1. OCR411 Is an Information Website

OCR411 is an independent informational website focused on obstacle course racing and related subjects.

The Site may contain race information, commentary, training concepts, safety information, gear discussions, event information, organization profiles, community observations, cost information, third-party references and other material intended to help readers understand obstacle course racing.

OCR411 is not a race organizer, sanctioning organization, governing body, medical provider, emergency service, professional coaching service, law firm or financial adviser.

2. General Information Is Not Professional Advice

Content on OCR411 is provided for general educational and informational purposes.

Nothing on the Site constitutes individualized medical advice, diagnosis, treatment, medical clearance, rehabilitation advice, legal advice, financial advice, professional coaching or an individualized exercise prescription.

Use of OCR411 does not create a physician-patient, trainer-client, coach-athlete, attorney-client or other professional relationship between you and OCR411 or any person associated with the Site.

Health and safety information must be read together with the OCR411 Medical & Safety Disclaimer.

3. Obstacle Course Racing Involves Genuine Risk

Obstacle course racing and related training are physically demanding activities that may involve substantial risks, including serious injury, permanent disability and death.

OCR411 does not determine whether you are physically or medically capable of participating in a particular event, attempting an obstacle, performing a training activity or using particular equipment.

You are responsible for deciding whether and how to participate based on your own circumstances, the actual conditions you encounter, the organizer’s current requirements and any professional advice appropriate to you.

Nothing in these Terms or elsewhere on OCR411 guarantees that a race, obstacle, exercise, technique or product is safe for you.

4. OCR411 Does Not Control Third-Party Races

OCR411 does not organize, supervise, inspect, construct, maintain or control third-party obstacle races, courses, venues or obstacles merely because they are discussed or listed on this Site.

Race organizers control matters including course design, obstacle construction, staffing, medical support, safety procedures, participant requirements, refunds, scheduling, pricing, weather decisions, event cancellation, rules and enforcement.

Information published on OCR411 is not a substitute for the organizer’s current rulebook, athlete guide, registration terms or race-day instructions.

If OCR411 information conflicts with current instructions issued by the organizer or appropriate race, medical or emergency personnel at your event, follow the appropriate current official instruction.

5. Information Can Change

OCR411 makes reasonable efforts to publish useful information, but obstacle course racing changes continuously.

Race dates, venues, organizations, ownership, distances, obstacles, prices, penalties, divisions, schedules, policies, affiliate arrangements and other information may change after an article is published.

OCR411 does not guarantee that every item of information will always be complete, current, error-free or appropriate for a particular purpose.

You are responsible for independently verifying time-sensitive, safety-critical, financial or event-specific information with the appropriate primary source before acting on it.

6. Your Responsibilities

When using OCR411, you are responsible for your own actions and decisions.

You agree to use reasonable judgment, comply with applicable laws and event rules, and obtain qualified professional assistance where appropriate.

You are responsible for any equipment you select, purchases you make, events you enter, information you submit and activities you choose to undertake.

7. User Submissions

OCR411 may permit users, race organizers or other parties to submit comments, corrections, race information, event information, website links, photographs, descriptions or other material (“User Content”).

You retain whatever ownership rights you lawfully hold in your User Content.

When you submit User Content for possible publication, you grant OCR411 a non-exclusive, worldwide, royalty-free license to store, reproduce, edit, format, display, publish and distribute that material as reasonably necessary to review, publish, promote, maintain and archive the Site and its content.

This license includes reasonable editorial changes such as correcting formatting, spelling, grammar, capitalization, layout and presentation. OCR411 will not acquire ownership of your underlying copyright merely because material is submitted.

Submission does not guarantee publication.

8. Your Representations About Submitted Content

By submitting User Content, you represent that:

  • You have the right to submit the material.
  • Your submission does not knowingly infringe another person’s copyright, trademark, privacy, publicity or other legal rights.
  • You are not impersonating another person or organization.
  • You are not knowingly submitting materially false or deceptive information.
  • Your submission does not contain malicious code or material intended to damage or interfere with the Site.

If you submit information on behalf of a race organization, business or other entity, you are responsible for having appropriate authority to do so.

9. OCR411 May Moderate or Remove Submissions

OCR411 may review, decline, edit, correct, remove or discontinue displaying User Content at its discretion, subject to applicable law.

OCR411 is not required to publish a race listing, correction, comment or other submission merely because it was provided.

Publication of submitted material does not mean OCR411 endorses the person or organization that submitted it.

10. Prohibited Uses

You may not use OCR411 to:

  • Violate applicable law or encourage unlawful activity.
  • Knowingly submit false, fraudulent, defamatory or materially misleading information.
  • Impersonate another person, race organization, company or government entity.
  • Infringe intellectual-property, privacy, publicity or other legal rights.
  • Transmit malware, malicious code or harmful software.
  • Attempt unauthorized access to the Site, its administrative systems, accounts, servers or networks.
  • Interfere with, overload, disable or disrupt the Site or services used to operate it.
  • Collect personal information about other users unlawfully.
  • Use automated systems to systematically scrape, copy or extract substantial portions of OCR411 without authorization, except for ordinary search-engine indexing or other activity permitted by law.
  • Use OCR411 content to falsely suggest endorsement, sponsorship, partnership or affiliation with OCR411.

11. OCR411 Content and Intellectual Property

Unless otherwise indicated, original articles, editorial text, graphics, site design elements, compilations and other original material created for OCR411 are owned by OCR411 or its applicable owner or licensor and are protected by applicable intellectual-property laws.

You may access and use OCR411 for ordinary personal, noncommercial informational purposes.

You may quote limited portions of OCR411 content for purposes such as commentary, criticism, discussion or citation where permitted by law and with appropriate attribution.

You may not reproduce, republish, sell, systematically copy or distribute substantial portions of OCR411 content as your own publication or database without permission, except where applicable law independently permits the use.

12. Third-Party Names and Trademarks

OCR411 discusses third-party race organizations, products and companies.

Names, logos, trademarks and service marks belonging to Spartan, Tough Mudder, Savage Race, Terrain Race or other third parties remain the property of their respective owners.

Reference to a third-party name or trademark for informational, comparative or identification purposes does not by itself mean OCR411 is sponsored by, endorsed by, affiliated with or officially connected to that organization.

13. Copyright Concerns

If you believe material appearing on OCR411 infringes a copyright or other intellectual-property right that you own or are authorized to enforce, contact OCR411 through the Contact page and identify the material, its location on the Site, the right you believe is affected and sufficient information to allow the matter to be reviewed.

OCR411 may remove or restrict access to material while a legitimate rights complaint is evaluated.

14. Third-Party Links

OCR411 may link to websites operated by race organizations, retailers, manufacturers, government agencies, researchers, medical or public-health organizations and other third parties.

Those websites are independently controlled. OCR411 does not control and is not responsible for their content, security, availability, pricing, privacy practices, terms, products, representations or subsequent changes.

An external link does not constitute a guarantee of the third party or everything appearing on that website.

15. Purchases and Third-Party Transactions

Unless OCR411 expressly states otherwise, purchases made after following an external link are transactions between you and the applicable third-party merchant or service provider.

OCR411 does not control third-party inventory, prices, shipping, registration availability, refunds, warranties, customer service or transaction processing.

You are responsible for reviewing the current terms and policies of the third party before completing a transaction.

16. Affiliate Relationships and Advertising

OCR411 may participate in affiliate programs, display advertising, accept sponsorships or receive other compensation connected with certain content or links.

Material relationships will be disclosed as appropriate. Additional information appears in the Affiliate Disclosure and Editorial & Independence Policy.

Commercial relationships do not give third parties ownership of OCR411’s editorial conclusions merely because compensation may be available.

17. Privacy

Your use of OCR411 is also subject to the Privacy Policy, which explains how information may be collected, processed and disclosed through the Site.

OCR411 currently uses services including Google Analytics as described in that Policy.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, OCR411 and its content are provided on an “as is” and “as available” basis.

OCR411 makes no warranty that the Site will always be available, uninterrupted, secure or error-free, or that every item of content will always be complete, current, accurate or suitable for a particular person’s circumstances or purpose.

OCR411 does not warrant that following information found on the Site will prevent injury, produce a particular athletic result, allow successful completion of an obstacle, prevent illness or make a particular event appropriate for you.

Nothing in this section excludes a warranty or other legal protection that applicable law does not permit to be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, OCR411 and its owner, operator, authors and contributors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to use of, inability to use or reliance on the Site.

This includes, to the extent permitted by law, losses resulting from reliance on outdated race information, third-party websites, unavailable events, purchase decisions, user-submitted information, interruption of the Site or decisions made using general informational content.

For claims involving purely economic loss and not involving liability that applicable law prohibits OCR411 from limiting, OCR411’s aggregate liability arising from use of the Site will not exceed the greater of (a) $100 or (b) the amount you paid directly to OCR411 for the applicable Site service during the twelve months immediately preceding the event giving rise to the claim.

Nothing in these Terms waives, releases, excludes or limits liability, rights or remedies that applicable law does not permit to be waived, released, excluded or limited.

20. OCR Participation and Personal Injury

Participation in obstacle course racing, exercise or other physical activity is separate from merely accessing this website.

OCR411 does not operate the third-party activities discussed on the Site, and you remain responsible for deciding whether to participate and for following appropriate professional and event-specific guidance.

Nothing in these Terms is intended to operate as an unlawful prospective release of liability for personal injury or to eliminate any legal duty or remedy that cannot validly be eliminated under applicable law.

21. Indemnification for Your Misconduct or Submissions

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless OCR411 and its owner and operator from third-party claims, liabilities, damages and reasonable costs arising from:

  • User Content you submit that unlawfully infringes another person’s rights;
  • Your unlawful or fraudulent use of the Site;
  • Your material violation of these Terms; or
  • Your unauthorized interference with the Site or its systems.

This indemnification provision does not require you to indemnify OCR411 for liability that applicable law does not permit OCR411 to transfer to you.

22. Site Availability and Changes

OCR411 may modify, suspend, discontinue or remove any portion of the Site or its content at any time.

OCR411 does not guarantee that any particular article, event listing, feature or service will remain available permanently.

23. Restriction of Access

OCR411 may restrict access to interactive features or take reasonable technical measures against users or systems engaged in spam, abuse, security attacks, unlawful activity, unauthorized scraping or other conduct that interferes with the Site.

24. Minors

OCR411 is a general-audience informational website and is not directed to children under 13.

If you are not legally capable of entering a binding agreement in your jurisdiction, you should not submit content or use features requiring contractual consent without involvement of a parent or legal guardian where required.

Parents and guardians remain responsible for evaluating whether obstacle course racing or related activities are appropriate for minors in their care and for complying with each organizer’s current age and supervision requirements.

25. Governing Law

Except to the extent that applicable law requires otherwise, these Terms and disputes concerning their interpretation will be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles that would require application of another jurisdiction’s law.

Nothing in this provision is intended to deprive a consumer of a mandatory statutory protection that cannot lawfully be varied by agreement.

26. Forum for Disputes

To the extent permitted by applicable law, disputes arising from these Terms or use of OCR411 that are pursued in court shall be brought in a court of competent jurisdiction located in the Commonwealth of Virginia that has lawful jurisdiction over the parties and the dispute.

This provision does not override a forum, venue or jurisdictional right that applicable law does not permit the parties to alter.

27. Severability

If a court of competent jurisdiction determines that a provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum lawful extent or severed as appropriate, and the remaining provisions will continue in effect unless applicable law requires otherwise.

28. No Waiver

OCR411’s failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision on a later occasion.

29. Relationship to Other OCR411 Policies

These Terms should be read together with the Privacy Policy, Medical & Safety Disclaimer, Affiliate Disclosure, Editorial & Independence Policy and any additional disclosure appearing on a particular page.

If a specific page contains an additional safety, affiliate, sponsorship or other disclosure applicable to that content, the additional disclosure should also be considered.

30. Changes to These Terms

OCR411 may revise these Terms as the Site, its services or applicable requirements change.

The “Last updated” date at the top identifies the current version. Revised Terms apply prospectively to use of the Site after the revised version becomes effective, subject to any additional notice or consent required by applicable law.
